TivaCare Anesthesia — Terms and Conditions

1. SERVICES

TivaCare Anesthesia, LLC ("TivaCare") provides professional anesthesia services to dental offices and surgical centers. These terms govern your use of TivaCare scheduling and payment services.


2. APPOINTMENTS AND DEPOSITS

A non-refundable deposit is required to secure all scheduled anesthesia appointments. The deposit amount varies by dental office and procedure and will be confirmed at the time of booking. The deposit is applied toward your total balance.


3. CANCELLATION POLICY

Deposits are non-refundable upon cancellation. TivaCare also reserves the right to retain the deposit if a patient fails to comply with pre-operative fasting instructions.


4. BILLING

Anesthesia fees vary by procedure type, duration, and the contracting dental office. Specific charges and any applicable discounts are communicated to the patient prior to the appointment.


5. PAYMENT

TivaCare accepts cash, credit cards, debit cards, and HSA/FSA cards. Checks are not accepted. Payment is due at the time of service.


6. SMS CONSENT

At a TivaCare-affiliated dental or surgical office, front-desk staff read the SMS consent disclosure aloud to the patient (or parent/guardian for pediatric cases) during booking, then record the patient's verbal agreement via an on-screen attestation checkbox; the booking will not submit without the checkbox. The consent record is stored in TivaCare's booking system with timestamp, case number, attesting staff identity, and the patient's phone number. By providing your phone number through this process, you consent to receive transactional SMS messages from TivaCare Anesthesia at the phone number provided, including appointment confirmations, deposit and balance payment links, pre-procedure fasting and arrival reminders, and post-procedure follow-up messages. Message frequency varies, typically 3-5 per appointment. Message and data rates may apply. Reply STOP to opt out at any time. Reply HELP for help. Consent to receive SMS is not a condition of receiving anesthesia services. Mobile information collected for SMS consent or opt-in will not be shared with third parties or affiliates for marketing or promotional purposes.


7. MEDICAL DISCLAIMER

TivaCare provides anesthesia services under the direction of a licensed anesthesia provider. All medical decisions are made by qualified healthcare professionals. These terms do not create a patient-provider relationship independent of your scheduled procedure.


8. LIMITATION OF LIABILITY

TivaCare liability is limited to the amount paid for services. TivaCare is not liable for indirect, incidental, or consequential damages.


9. GOVERNING LAW

These terms are governed by the laws of the State of Utah.
